【発表要旨】

Land Disputes in Indonesia after Suharto’s Resignation

“Struggling for land or money? the Cimacan land dispute during
the era of reformasi 1998-2008”

How did 31 hectares of rich market gardens in a fertile river valley of the Puncak region, two hour’s drive from Jakarta, become a golf course? In this case study, the history of the Cimacan land dispute will be traced from its beginnings as a tea plantation through the high expectations raised by the land reform legislation in the 1960s, the dispossession of the smallholder farmers of Cimacan from their land under Suharto, and their subsequent efforts to reclaim these rights. I will analyze farmers' long standing resistance to the golf course and tourist development, and the effectiveness of support the local community secured from outside Cimacan, with a particular focus on the role of NGOs and the role of the Indonesian legal system in the process.
Finally, it reviews developments in this land dispute in the ten years since the fall of the Suharto regime, and attempts to solve the dispute by the children of those who lost their land in the late 1980s, who continued their parents activism in the recently decentralized and democratically Cimacan Village Council It raises questions concerning the ability of peasant cultivators to continue the struggle for their land against powerful market forces, the limits of political change in land policy in the face of countervailing national and global interests in the so-called 'Reform Era', as well as governance issues at the village level.

“LARGE-SCALE PALM OIL PLANTATION DEVELOPMENT, RECOGNITION OF
LOCAL PEOPLE’S CUSTOMARY RIGHTS AND AGRARIAN CONFLICTS IN
INDONESIA AFTER THE FALL OF PRESIDENT SOEHARTO: A LESSON
LEARNED FROM THE PROVINCES OF WEST SMATRA AND RIAU”

This paper scrutinizes agrarian conflicts in Indonesia after the fall of President Soeharto by paying attention to the relationship between the development of large-scale palm oil plantations, customary land relinquishments and the conflicts. A world’s agreement stipulates that customary rights of indigenous people based on their customary laws on land must be recognized. United Nation’s declaration of indigenous rights specifies that the state must acknowledge indigenous people’s rights over natural resources. Roundtable Sustainable Palm Oil’s (RSPO) principle and criteria also state the same thing. In Indonesia, NGO activists also call for the respect of indigenous people’s rights over natural resources. This is intended to protect local people’s rights over natural resources.
In the Provinces of West Sumatera and Riau the local governments recognize the existence of customary land, but this official recognition did not lead to the respect of local customary laws and the fulfillment of local people’s rights over natural resources when land was allocated by the government for the establishment of investors’ large-scale palm oil plantations during the New Order. This resulted in widespread conflicts between holders of customary land and palm oil plantation companies in these two provinces when political changes after the fall of President Soeharto in mid-1998 created an opportunity for local people to carry out collective actions.

国際ワークショップのお知らせです。

１月１７日(土)に「スハルト退陣後のインドネシアにおける
土地紛争」についての国際ワークショップが、法政大学で
開かれます。

報告者は、豪州フリンダース大学の東南アジア研究所長
のアントン・ルーカス（Anton Lucas）先生と、インドネシア
のアンダラス大学社会政治学部上級講師のアフリザル（Afrizal）
先生です。

報告内容についての詳細は、また改めて、お知らせします。

インドネシアの土地紛争は、スハルト以後の状況の中でも
